Basis of Sale
These terms and conditions represent the complete agreement between you, the customer, and Eco Clear Midlands Ltd, excluding any other terms or conditions unless agreed upon in writing.

When we provide a quote without a prior site inspection, your acceptance of the quote (via phone, email, or otherwise) creates a binding contract.

We reserve the right to amend our quoted price if:

The information provided by you at the time of the quote is incomplete or inaccurate.

New information about the waste or collection site arises during the collection process.

Unless otherwise stated, all quotes provided in advance of a collection are estimates only.
Provision of Services
We aim to deliver our services with reasonable care and professionalism unless prevented by unforeseen circumstances (e.g., Force Majeure).

While we strive to meet specified collection dates, delays may occur due to factors beyond our control. In such cases, we will inform you promptly and reschedule.

You are responsible for providing safe and unrestricted access to the collection site. You must inform us in advance of any special circumstances that could impact the job, including but not limited to:

Hard-to-reach locations

Large or heavy items
-
Work at height requirements
-
Secured or restricted waste
-
Parking restrictions near the site

Failure to provide accurate or complete information may result in additional charges or the cancellation of the collection.

If we arrive at the collection site in your absence, you must ensure we can contact you and process payment. Failure to do so may result in a failed collection for which we are not liable.

By booking a collection, you confirm that you have the authority to authorise the disposal of the waste. You indemnify Eco Clear Midlands Ltd against any claims or expenses arising from unauthorised waste clearance.

We reserve the right to refuse collection if hazardous materials, such as asbestos or drug paraphernalia, are detected. If hazardous items have already been loaded, additional charges may apply for their safe disposal.
Payment and Pricing

All prices are subject to VAT.

Our pricing is primarily based on:
-
An attendance fee
-
The volume of waste collected, measured in cubic yards
-
Visual estimates are used to determine the cost, but weights may be verified post-collection using weighbridge tickets.

Non-account customers must pay the attendance fee at the time of booking. This fee covers attendance only and does not guarantee waste removal.

Payment is required at the time of collection unless otherwise agreed. Failure to pay may result in the return of waste and additional charges.

Late payments will incur the following administration fees:

£40 for invoices up to £999.99
-
£70 for invoices up to £9,999.99
-
£100 for invoices over £10,000.00
-
Interest at 8% above the Bank of England’s base rate may also be applied.

Invoices must be paid within 30 calendar days unless prior arrangements are made. Overdue invoices may result in suspension or cancellation of services.
Cancellations and Charges

Cancellations made before the business day preceding the collection date may qualify for a refund of the attendance fee.

For consumer contracts, cancellations can be made within 14 days of booking unless the service has already commenced.

Recurring services require 28 days' written notice for cancellation.

Additional charges may apply for:

Labour exceeding allocated time

Difficult waste (e.g., fridges, tyres)

Additional services requested onsite
Limitation of Liability

Eco Clear Midlands Ltd does not provide legal advice regarding waste disposal. Customers are responsible for ensuring the legality of their instructions.

We accept no liability for:
-
Indirect or consequential loss
-
Damage not reported before our team’s departure or within 7 days of service completion.

Our total liability for any loss shall not exceed the total price of the service.

This clause does not exclude liability for death, personal injury, fraud, or other legally mandated protections.
Events Outside Our Control
We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to:

Natural disasters

Acts of terrorism or war
-
Transportation or communication disruptions
Obligations under these terms will be suspended during such events, with timeframes adjusted accordingly.
Termination
We reserve the right to end the agreement between us at any time. This termination does not affect any existing rights or obligations of either party, including our ability to recover any outstanding payments due under these terms.
Assignment

You must obtain our prior written consent before transferring any of your rights or responsibilities under these terms to another party. We will not unreasonably withhold such consent.

We reserve the right to transfer all or part of our rights and obligations under these terms to another organisation. Such a transfer will not affect your rights under these terms.

Notices sent to you will be directed to the email or postal address you provided when booking. Notices will be considered received 24 hours after being sent via email or three days after posting. Proof of sending will suffice to establish receipt, provided the email is sent to the correct address or the letter is properly addressed, stamped, and mailed.
Data Protection

Your personal information will only be used to provide services or inform you about similar services unless you request otherwise.

You agree that we may share your details with credit reference agencies and other parties in compliance with data protection laws and as specified in our registration as a data controller.
General

If any part of these terms is deemed invalid or unenforceable by a court or relevant authority, the remainder will remain valid to the fullest extent allowed by law.

Failure to enforce any part of these terms does not constitute a waiver of our rights. Waivers will only be effective if explicitly stated in writing.
These terms are governed by English law, and any disputes will be subject to the exclusive jurisdiction of the English courts.
